James Anaya, the new Special Rapporteur on the United Nations Declaration on the Rights of Indigenous Peoples, has posted “The Human Rights of Indigenous Peoples, in Light of the New Declaration, and the Challenge of Making Them Operative: Report of the Special Rapporteur on the Situation of Human Rights and Fundamental Freedoms of Indigenous People.” Here is the abstract:
The present report is submitted in accordance with Human Rights Council resolution 6/12, and is the first report of Professor S. James Anaya in his capacity as Special Rapporteur on the situation of human rights and fundamental freedoms of indigenous people. The resolution requires the Special Rapporteur, inter alia, to promote the United Nations Declaration on the Rights of Indigenous Peoples and other international instruments relevant to the advancement of the rights of indigenous peoples. On this basis, the Special Rapporteur provides an analysis of the Declaration, in the context of other international instruments specifically regarding indigenous peoples and human rights instruments of general applicability. Reflecting the common international body of opinion regarding the rights of indigenous peoples, the Declaration elaborates on general human standards as they apply to the specific context of indigenous peoples, with a particular emphasis on the remedial measures required to address the historical and contemporary denial of their rights. The last section of the report analyses the different measures required to implement and make operative the rights affirmed in the Declaration, a process which involves a joint effort by States, the United Nations system, indigenous peoples and relevant civil society actors.
We would like any comments on the Rights of us, the First People on this Land called Australia now, as in the UN Declaration on our Rights as Indigenous People which was passed on 13 September 2007, but was opposed by Australian Government of JohnHoward and we believe Kevin Rudd is just as bad and his Government is doing the same, after promising they would accept the Declaration at the UN. Has Rudd accepted it at the UN? Why will he not make it law in Australia? Why are they frightened to accept our Rights and to accept us as human beings. We as Nyungah People suffer every day by the denial of our Rights, as do all Aboriginal People. Governments are trying to force us to accept and assimilate into their greedy, selfish, destructive way of Life. No protection of our Sacred Places in WA. No acceptance of our rights to educate our children according to our Culture and Language. No assistance to our communities, just white ideas forced on us.
But we the Grassroots People will never change. We love and respect our Laws and Customs, and we will keep standing against the continual destruction of our Sacred Places – for instance, the Seven Sisters Dreaming north-east of Southern Cross which is important to Aboriginal People all over the Land called Australia now, and especially to Aboriginal Women, and white women too, which is being dug up and destroyed by Portman’s and shipped to China, for bullets and cars. (The Green Senator Scott Ludlam has a 4 minute film showing the destruction). And there is Wright Lake near Perth, destroyed for an artificial rowing canal. The Ancient Things of our Ancestors at Murujuga – the Burrup Peninsula, and at Munday Swamp where the Perth Airport is, with our Ancestors tools far older than Stonehenge, far older than the Pyrimids. And our Sacredness in Wetlands, Creeks and Rivers being dug up, destroyed, polluted. The only white law of protection gives permission to ‘disturb, damage, or destroy’ a Sacred Site (s18, Aboriginal Heritage Act 1972). None of the protecting sections are ever used.
We are under constant Government and media attack in our communities, lies and conspiracies against us. Police ramming our teenagers and killing them in high speed chases, many unexplained Black deaths, where there has never been justice. Western Australia is No. 1 Racist State. ABC Lateline is Australia’s No 1 Racist media – never yet admitted their lies about Mutijulu and the mad Brough’s man posing as a youth worker and fabricating abuse stories to Lateline, or the malicious and dishonest Nanette Rogers, the magistrate, who has been exposed but ignored by most mainstream media. And the whole intervention conspiracy. We say Howard, Brough, Pearson, Rudd, Macklin should be charged, tried and gaoled for their malicious dishonesty and the distress, harm and damage they have caused the Aboriginal People.
Any assistance in international law would assist the Aboriginal People of Australia.
