Maybe this explains why tribal interests lose so often in court. Someone needs to do the same study, only with tribal lawyers as the subject.

    If we could all accurately predict the outcome of litigation, there would be no need for trials! I think it would also be interesting to look at other factors involved in the outcome, such as whether a Rule 68 offer was made and the final settlement offers exchanged between the parties. And, while it probably would be difficult information to obtain, it would be interesting to know whether there is a difference between what an attorney publicly states about the expected outcome of a case and what she or he tells the client.
