Updated Supreme Court Justice Report Card

Here’s an updated report card on the Supreme Court Justices’ holdings in Indian Law after yesterday’s United States v. Tohono O’odham Nation decision.

Justices Roberts, Alito, and Sotomayer now “lead” the pack at 0% in favor of tribal interests (0/6, 0/5, and 0/1, respectively).  Justices Thomas and Scalia clock in at 10.2% (4/39) and 17.3% (9/52) respectively.  Rounding out the bench are Justices Kennedy – 17.7% (8/45), Breyer – 30% (9/31) and Ginsburg – 38.2% (13/34).  Justice Kagan is still nil at 0/0.

Thus, the current make-up of the Supreme Court has found in favor of tribal interests only 20.1% (43/213) of the time.
