    Just a quick clarification. The revised leasing regulations are independent of the HEARTH Act and they lay out an improved process for old-fashioned leasing with Secretarial approval. However, they are directly relevant to HEARTH. Under the Act, tribes can approve their own surface leasing regulations, under tribal regulations that are “consistent with” the Interior regulations. So the new Part 162 should help with implementing HEARTH.
