The materials on MacArthur v. San Juan County (No. 07-701) are here. The petition is set for the Court’s conference on Feb. 15.
As I’ve noted before, there is no chance the Court will grant cert here. The reply brief, for example, argues that the Montana rule should apply only at Crow (if only that were true!, sorry Crow).
