it would seem that ultimately what is at issue here is who decides what indian belongs where. Tribes have a right to determine membership in whatever messy political environment they find themselves in. Yes, Tribes will have to deal with baggage from BIA and federal decisions that have “formerly” determined membership years, decades, centuries ago. Yes, the BIA/Feds will have to deal with a messy transition where Tribes are speaking up about who was place on the rolls and for whatever BIS/Fed then exisitng incentive shaped those prior decisions. But unlike the BIA/Feds we indians can tell one Indian from another and will make these decision as is our right.
My fear is what the BIA/Fed will do when they have an increasing “At-Large” indian popluation with no tribal affliation but still due federal protection? Will this resultant “protected class” join the ranks of other gender/age/religous/GLBT/unborn protected classes and further blur the “political status” afforded Tribal sovereigns?
