Poitra, Defendant, made a motion to dismiss arguing the federal district court lacked subject matter jurisdiction. In his motion, Poitra argued Ford failed to exhaust tribal court remedies. The district court denied the motion to dismiss, but the case was dismissed March 2, 2011, with the federal district court stating the case must be resolved in tribal court, which was what was argued in the motion to dismiss. I represented Poitra in fed ct.
