NAVAJO NATION OFFICE OF LEGISLATIVE COUNSEL

The Office of Legislative Counsel seeks to fill the Chief Legislative Counsel position to work with the Legislative Branch of the Navajo Nation Government.

The Chief Legislative Counsel serves as legal counsel to the Navajo Nation Council; provides comprehensive legal guidance and advice to the Navajo Nation Council, standing committees, boards, commissions, and the Legislative Branch; coordinates with the Department of Justice and other attorneys  in providing legal services to the Nation; provides advice and representation, interpretation of law, research, analysis and representation in mediation and administrative hearing; provides training and orientation in specific laws and areas of law; directs and performs complex legal research and analysis of laws, legal precedents, and issue; drafts, reviews and prepares proposed legislation, reports, legal documents, and correspondence for the Navajo Nation Council and entities of the Legislative Branch; responsible for the codification of Navajo Nation laws, rules and regulations; develops annual work plan and budget for the Office of Legislative Counsel; attends meetings, training and seminars in support of continuing legal education requirements; prepares and submits activity reports to the Office of the Speaker.

The Chief Legislative Counsel must have a Juris Doctorate and twelve (12) years of professional work experience as a state licensed attorney, four (4) years of which must have been in a supervisory or lead capacity. Current admission in any state bar with the intention of seeking and securing admission to the Navajo Nation Bar Association and either the Arizona, New Mexico or Utah Bar within one (1) year of date of hire.

The Chief Legislative Counsel serves as legal counsel to the Navajo Nation Council at a negotiated salary. Veterans’ Preference applies. The Navajo Nation will give preference to qualified applicant in accordance with the Navajo Preference in Employment Act.

 Join NCAI and our partners on a webinar this Thursday, May 9, 2013 at 2:00 p.m. eastern time to review draft comments and provide input on the IRS’ General Welfare Exclusion.

During the 2012 White House Tribal Nations Summit, the IRS released Proposed Guidance in Notice 2012-75 for how its Office of Indian Tribal Governments will examine certain programs administered by tribal governments, including programs for housing, education, elder and travel assistance, as well as cultural programs. In that notice, the IRS designated a June 3 comment deadline for tribes to submit suggestions and comments on the proposed guidelines.

NCAI, in partnership with the United South and Eastern Tribes (USET), the Affiliated Tribes of Northwest Indians (ATNI), the California Association of Tribal Governments (CATG), the United Indian Nations of Oklahoma, Kansas and Texas (UINOKT), the Midwest Alliance of Sovereign Tribes (MAST) and the Native American Finance Officers Association (NAFOA), has developed Draft Joint Comments on behalf of tribal nations.

Professor Barbara Creel Receives Faculty of Color Award

Congratulations to Professor Barbara Creel from the University of New Mexico School of Law. On April 30, 2013, Professor Creel was honored by the Project for New Mexico Graduates of Color in the UNM Office of Graduate Studies Special Initiatives. Thirty-three different professors were nominated, and Professor Creel received the All-Around Award, which recognizes an exceptional individual who positively impacts students of color and the UNM community at large.

DAKOTA PLAINS LEGAL SERVICES (DPLS), a non-profit legal services program, is accepting applications for a Managing Attorney position in our Mission, South Dakota, branch office.  The Mission office serves the Rosebud Sioux Indian Reservation in South Dakota and Gregory, Jones, Mellette, Todd and Tripp counties in South Dakota.

QUALIFICATIONS/RESPONSIBILITIES: Applicants must have a JD degree and be licensed to practice in South Dakota, or willing and qualified to take the next South Dakota Bar Exam; must be a bright, motivated, self-starter; must have the tenacity to assume immediate practice responsibilities, including handling a significant caseload touching on many different areas of law with regular appearances in court; must demonstrate an interest in poverty law and working with Native American and low income clients; and must commit to a minimum of a two year employment period, upon completion of a six month probationary period.  Applicant must have at least one year experience in the practice of poverty law or Indian law, with trial and appellate experience in state and federal courts or two years experience in the general practice of law.  If Applicant does not possess this experience we would consider Applicant for a staff attorney position until qualified to be a Managing Attorney.
