North Dakota SCT Affirms State Court Jurisdiction over Reservation Housing Eviction Matter

Here is the opinion in Gustafson v. Poitra: Opinion

Excerpt:

Linus and Raymond Poitra appeal the district court judgment of eviction. The Poitras argue the district court erred by exercising jurisdiction over this matter, and by sending a North Dakota law enforcement officer onto the reservation to evict tribal members from property within the Turtle Mountain Reservation. We affirm.

Federal Court Dismisses Gustafson v. Poitra Dispute (Again)

Here are the materials in Gustafson v. Poitra (D. N.D.):

19 Motion to Dismiss

23 Response

34 DCT Order

An excerpt:

The Court notes the equities clearly favor the Gustafsons, and the Court is sympathetic to the jurisdictional dilemma they find themselves in. The juvenile behavior and attitude of the Poitras that triggered the need for the issuance of the TRO in October 2012 is difficult for any reasonable person to understand. However, the plaintiffs cannot use the Declaratory Judgment Act as a vehicle to resolve a multitude of long-standing disputes which neither raise a federal question nor bear any relationship to a lawsuit over which the Court would have jurisdiction.

We have posted on the multiple suits in this long-running dispute here, here, and here.

Gustafson v. Poitra Cert Petition

Here is the petition (docket no. 11-701):

Gustafson v Poitra Cert Petition

Here are the questions presented:

1. Whether the State of North Dakota can supplant its own state case law, instead of federal law on jurisdictional disputes between state courts and tribal courts.
2. Whether the State of North Dakota has subject matter jurisdiction over a contract dispute between a nonmember individual and a member of an Indian tribe arising from the ownership and use of a building located on non-Indian owned fee land on an Indian reservation.
Here is the lower court opinion. Here is Gustafson’s lower court brief. And Poitra’s. Poitra was pro se.

Chaotic Land Dispute Case at Turtle Mountain Dismissed from Federal Court

Here is the district court opinion in Gustafson v. Poitra — Gustafson DCT Order
