The Navajo Nation delivered a proposed funding agreement to the Bureau of Indian Affairs, an agency within the United States Department of the Interior, during a partial government shutdown. By law, the BIA had 90 days after receipt to act on the proposal or it would be deemed approved. The BIA did not consider the proposal “received” until normal government operations later resumed, and issued a partial declination 90 days after that date. The Nation filed an action to enforce the proposal, contending that the BIA’s declination was untimely. The district court granted summary judgment to the DOI, holding that because the Nation had remained silent when the BIA indicated its position on the deadline, the Nation was equitably estopped from asserting an earlier one. The Nation brought the present appeal. We reverse the judgment.

Aaron Payment, the chairman of the Sault Tribe of Chippewa Indians in Michigan, said his tribe had already shut down its H.I.V. prevention program and furloughed employees for its Head Start program for a month because of sequestration.
Now, with nearly $1 million in federal money lost since the shutdown, the tribe is scrambling to shift casino revenue from other programs to keep its government afloat.
“We’re in turmoil right now,” Mr. Payment said. “The impact here is going to be felt by the people who need the services the most.”
Kevin Washburn, assistant secretary for Indian affairs, said the shutdown could have long-term effects on tribes and tribal members. Financial deals and economic programs have been suspended. Environmental reviews of tribal projects will be delayed. And the impact on the thousands of Bureau of Indian Affairs employees who have been furloughed is compounded because many support poor relatives, he said.

According to staff at the House Committee on Natural Resources, the Bureau of Indian Affairs (BIA) manages or supervises many of the day-to-day affairs of Indian Reservations, particularly the large land-based tribes west of the Mississippi. They are under the assumption that if money were cut off to the BIA they expect “critical” services relating to law enforcement (i.e., BIA police), Indian Health Services relating to life and limb, resource protection will continue. But other operations, such as reviewing and approving a lease of Indian or tribal land to building a house, to sending a check to an Indian, to providing day care, running some dams and irrigation projects, drilling oil and gas, running Indian school operations would shut down. Non-essential personnel, such as a receptionist in a health clinic, might be furloughed. They are under the impression that essential personnel (i.e. doctors, etc) must work. Also, under a certain law, many tribes throughout the U.S. effectively bypass the BIA and receive appropriated money directly – they then provide services through tribal structures rather than through the BIA bureaucracy. Unless the tribes have amassed some reserves, their funding would cease. While well over a hundred tribes operate casinos, not all provide large profits. Most of them receive federal dollars.
