The General Accounting Office has published a report, HUMAN TRAFFICKING: Information on Cases in Indian Country or that Involved Native Americans.
Summary:
All four federal agencies that investigate or prosecute human trafficking in Indian country—the Federal Bureau of Investigation (FBI), the Bureau of Indian Affairs (BIA), U.S. Immigration and Customs Enforcement (ICE), and the U.S. Attorneys’ Offices (USAO)—are required to record in their case management systems whether a human trafficking offense was involved in the case. With the exception of ICE, these agencies are also required to record in their case management systems whether the crime took place in Indian country. ICE officials explained that the agency does not record this information because, unlike BIA and the FBI, ICE is not generally involved in criminal investigations in Indian country. Typically, ICE would only conduct an investigation in Indian country if specifically invited by a tribe to do so. Further, with the exception of BIA, these agencies do not require their agents or attorneys to collect or record Native American status of victims in their cases due to concerns about victim privacy and lack of relevance of the victim’s race to the substance of the investigation or prosecution.
The Departments of Justice (DOJ), Health and Human Services (HHS), and Homeland Security (DHS) administered at least 50 grant programs from fiscal years 2013 through 2016 that could help address Native American human trafficking. For example, 21 of these grant programs, which were administered by DOJ and HHS, could be used to provide services to Native American human trafficking victims. However, the total number of Native American victims who received services under these grant programs is unknown. HHS is developing a data collection tool that grantees can use to report information on human trafficking victims served, including Native American status of victims. DOJ’s Office on Violence Against Women (OVW) requires grantees to report Native American status of victims served, but not by type of crime. DOJ’s Office for Victims of Crime (OVC) and the Office of Juvenile Justice and Delinquency Prevention (OJJDP) do not require grantees to collect and report Native American status of victims served. However, in fiscal year 2017, OVC began providing recipients of human trafficking-specific grant programs the option to report the race or Native American status of victims served. While Native American status may not generally be a factor for determining whether a victim can receive services, it may be a factor for determining how best to assist this particular demographic. According to the 2013-2017 Federal Strategic Action Plan on Services for Victims of Human Trafficking in the United States, expanding human trafficking data collection and research efforts for Native Americans and other vulnerable populations is an area for improvement for the federal government. Additionally, Standards for Internal Control in the Federal Government states that quality information should be used to achieve objectives based on relevant data from reliable sources. Without collecting data on the Native American status of victims served, federal agencies will not know the extent to which they are achieving government-wide strategic goals to provide and improve services to vulnerable populations, including Native American human trafficking victims.

The Department of Homeland Security (DHS) is coordinating in a variety of ways with tribes, such as through joint operations and shared facilities and Operation Stonegarden—a DHS grant program intended to enhance coordination among local, tribal, territorial, state, and federal law enforcement agencies in securing United States borders. However, the Border Patrol and tribes face coordination challenges. Officials from five tribes reported information-sharing challenges with the Border Patrol, such as not receiving notification of federal activity on their lands. Border Patrol officials reported challenges navigating tribal rules and decisions. Border Patrol and DHS have existing agreements with some, but not all, tribes to address specific border security issues, such as for the establishment of a law enforcement center on tribal lands. These agreements could serve as models for developing additional agreements between the Border Patrol and other tribes on their specific border security coordination challenges. Written government-to-government agreements could assist Border Patrol and tribal officials with enhancing their coordination, consistent with practices for sustaining effective coordination. DHS established an office to coordinate the components’ tribal outreach efforts, which has taken actions such as monthly teleconferences with DHS tribal liaisons to discuss tribal issues and programs, but does not have a mechanism for monitoring and overseeing outreach efforts, consistent with internal control standards. Such monitoring should be performed continually; ingrained in the agency’s operations; and clearly documented in directives, policies, or manuals to help ensure operations are carried out as intended. Implementing an oversight mechanism could help enhance DHS’s department-wide awareness of and accountability for border security coordination efforts with the tribes while identifying those areas that work well and any needing improvement.

Management challenges within the Department of Interior’s Office of the Assistant Secretary – Indian Affairs (Indian Affairs), such as fragmented administrative structures and frequent turnover in leadership, continue to hamper efforts to improve Indian education. For example, incompatible procedures and lack of clear roles for the Bureau of Indian Education and the Indian Affairs’ Deputy Assistant Secretary for Management (DAS-M), which provides administrative functions to BIE, such as human resources and acquisitions, contribute to delays in schools acquiring needed materials and resources. According to BIE officials, some DAS-M staff are not aware of the necessary procedures and timelines to meet schools’ needs. For instance, delays in contracting have occasionally affected BIE’s ability to provide services for students with disabilities in a timely manner. A study commissioned by Indian Affairs to evaluate the administrative support structure for BIE and the Bureau of Indian Affairs (BIA) — also under Indian Affairs — concluded that organizations within Indian Affairs, including DAS-M, BIA, and BIE, do not coordinate effectively an d communication among them is poor. Similarly, preliminary results from GAO’s work suggest that lack of consistent leadership within DAS-M and BIE hinders collaboration between the two offices.

Among the tribes that responded to our survey (109), none reported that they were exercising TLOA’s new sentencing authority, and, in open-ended responses, many tribes (86 of 90, or 96 percent) reported challenges to exercising this authority due to funding limitations. Tribes were relatively evenly split among those that reported that they have plans to exercise the new authority (36 of 101, or 36 percent); that they did not know the tribe’s plans to exercise the new authority (34 of 101, or 34 percent) because, for instance, the tribal council has not yet made a decision; and that they did not have plans to do so (31 of 101, or 31 percent). In addition, 64 percent of selected tribes (70 of 109) reported implementing at least half of the requirements necessary for exercising the new sentencing authority, but reported challenges in implementing other requirements. Specifically, these tribes most frequently reported implementing the requirement to maintain a record of the criminal proceeding, and least frequently reported providing the defendant a licensed defense attorney. For example, 8 tribes that described challenges to exercising the new sentencing authority reported challenges with the costs of implementing the requirements associated with the sentencing authority. In particular, 3 tribes reported challenges with the costs of providing a licensed judge with sufficient legal training as required under TLOA. As a result, tribal courts may be unable to impose prison sentences of over 1 year to 3 years per offense—as TLOA provides—and possibly provide a more effective deterrent to criminal activity in Indian country.
DOJ and BIA provide funding and technical assistance to tribes that can be used to help them exercise the new sentencing authority, and tribes reported that they desire additional funding and technical assistance from the federal government for this purpose. However, tribes do not always have a clear understanding about their eligibility for federal funding sources available to help them exercise the new sentencing authority. In its fiscal year 2011 solicitation for the Tribal Civil and Criminal Legal Assistance (TCCLA) grant, DOJ stated that consistent with its authorizing statute, eligibility is “limited to tribal and non-tribal non-profit (Internal Revenue Code (I.R.C.) § 501(c)(3)) entities that provide legal assistance services for federally recognized Indian tribes, members of federally recognized Indian tribes, or tribal justice systems pursuant to the federal poverty guidelines.” However, 6 of the 9 tribes or tribal entities that applied for TCCLA in fiscal year 2011 were ineligible—because they were not 501(c)(3) non-profit entities—yet DOJ did not explain to the tribes that they were ineligible for funding because they were not such entities. As a result, these tribes used resources to prepare applications explaining their intended use of the funding—which, for 4 of the 6 tribes, was to meet requirements necessary for exercising the new sentencing authority—when they were not eligible for the funding. DOJ officials agreed that they could update the letter used to inform applicants that they were not selected for funding to make it clearer that only 501(c)(3) nonprofit entities are eligible. Further, internal control standards state that agency management should ensure that there are adequate means of communicating with external stakeholders that may have a significant impact on the agency achieving its goals. By taking actions to better clarify that applicants must be 501(c)(3) non-profit entities to be eligible for TCCLA, both during the application process and when applicants are notified of their ineligibility, DOJ could better ensure that the tribes and DOJ will not use resources to prepare, review, and deny applications for grants for which tribes or certain tribal entities are not eligible. Moreover, tribes would also be better positioned to make informed decisions about the available funds to pursue.
