Hopi Tribe

Chief Prosecutor. Responsible for the executive and administrative control of the Tribal Prosecutor’s Office, as well as prosecuting crimes committed within the Hopi Reservation and its boundaries, and prosecuting delinquency and minor child in need of care petitions.

Probation Officer. Manages a case load and enforces court ordered probationary sentences by supervising and monitoring probationers under the direct supervision of the Chief Probation Officer. The incumbent performs paraprofessional duties requiring knowledge and skill in assessments, investigation, counseling, and supervision of probationers.

Deputy General Counsel. Provides professional legal counsel and representation to the Hopi Tribal government – including the legislative and executive branches of the Hopi Tribe, the administrative departments, offices, and programs – as specified by the Tribal Council and the General Council.

Licensed Deputy Prosecutor. Performs professional legal work in prosecuting criminal offense, juvenile offenses, and certain civil cases in the Hopi Tribal Courts, including legal research and preparation of Court documents; response to citizen inquiries relating to tribal court procedures and violations of Tribal laws prosecuted in Tribal Court.

Tenth Circuit Holds NIGC Indian Lands Opinion Letters Not Final Agency Action

An excerpt:

The question in this case is whether a legal opinion letter issued by the Acting General Counsel of the National Indian Gaming Commission (“NIGC”) regarding the eligibility of Indian lands for gaming constitutes “final agency action” subject to judicial review. In response to a request from the Quapaw Tribe, the NIGC Acting General Counsel issued a legal opinion letter stating that the Tribe’s Kansas trust land was eligible for gaming under the Indian Gaming Regulatory Act (“IGRA”). The State of Kansas and the Board of County Commissioners of the County of Cherokee, Kansas, filed suit, arguing that the letter was arbitrary, capricious, and erroneous as a matter of law. The district court concluded that the letter did not constitute reviewable final agency action under IGRA or the Administrative Procedure Act (“APA”).

Exercising jurisdiction under 28 U.S.C. § 1291, we affirm. IGRA’s text, statutory scheme, legislative history, and attendant regulations demonstrate congressional intent to preclude judicial review of legal opinion letters. Further, the Acting General Counsel’s letter does not constitute final agency action under the APA because it has not determined any rights or obligations or produced legal consequences. In short, the letter merely expresses an advisory, non-binding opinion, without any legal effect on the status quo ante.

EXPERIENCE & EDUCATION: Admitted to practice law and in good standing with the California Bar Association. One (1) year of legal experience working for an Indian Tribe, or a firm representing Tribal interests, or three (3) years of legal experience involving trial work in family law, elder law, child welfare or the Indian Child Welfare Act at the state, tribal or federal level, or other legal experience involving Indian law or related areas. Must have proven excellent past work record evidenced by favorable references from past employers. If no past employer, then letter of reference from either one California State Court Judge or two attorneys admitted to practice in the state in which they practice.  A Juris Doctor Degree from a recognized law school and membership in the California Bar Association. Must have a good academic law school recorded evidenced by law school transcripts.
