The Ute Mountain Ute Tribe is seeking an Associate General Counsel to work in-house with the Tribe’s Justice Department. Assignments cover a broad range of Indian Law topics, including natural resources, energy development, taxation, water, litigation, code development and economic development, just to name a few.

Ernest House, Sr., was born and raised in Mancos Canyon, Colorado. He is a member of the Ute Mountain Ute Tribe (Weeminuche Band) of the State of Colorado. As a respected tribal leader and former Chairman of the Ute Mountain Ute Tribe, he oversaw the Tribal Council and served as the President and Chief Executive Officer of Tribal Business and Enterprise.

Commissioner of Public Lands v. New Mexico Cert Petition

This new filing (commissioner-public-lands-cert-petition) is an appeal of a New Mexico appellate court decision (here). The case also involves the Jicarilla Apache Nation, Navajo Nation, and Ute Mountain Ute Tribe.

Here is the question presented:

Whether the New Mexico Commissioner of Public Lands may claim federal reserved water rights with respect to lands Congress reserved from the federal public domain, and granted to the State of New Mexico subject to a strict, federally enforceable trust, to support public education and for other related purposes specified by Congress.

U.S. v. Benally — CA10 Reinstates Conviction after Juror Alleged Racial Bias against Indian

In United States v. Benally, the Tenth Circuit reinstated a federal criminal conviction for assaulting a BIA officer against a Ute Mountain Ute tribal member. An excerpt:

On October 10, 2007, a jury convicted Kerry Dean Benally of forcibly assaulting a Bureau of Indian Affairs officer with a dangerous weapon, inviolation of 18 U.S.C. § 111(b). The next day one of the jurors came forward with a charge that the jury deliberations had been tainted by racial bias and other inappropriate considerations. The district court held that Federal Rule of Evidence 606(b)’s general rule against jurors testifying about jury deliberations did not apply and that the evidence of juror misconduct was sufficient to warrant a new trial. We disagree. Rule 606(b)’s prohibition covers juror testimony of racial bias in jury deliberations of the kind alleged in Mr. Benally’s trial, and the Sixth Amendment does not require an exception. The original conviction is reinstated.
