US v. Friday — Constitutional Challenge to National Eagle Repository Rejected
Here is the Tenth Circuit’s decision in United States v. Friday — us-v-friday-ca10 (thanks to Sarah Krakoff for the heads-up).

Border Fence Construction Cert Petition — Defenders of Wildlife v. Chertoff
The Tohono O’odham Nation joined an amicus brief supporting the cert petition in Defenders of Wildlife v. Chertoff (No. 07-1180) (amici-supporting-cert-petn-national-advocacy-center-et-al). The government has until May 18 to file a response. This is a potentially ground breaking case, given that the Department of Homeland Security has invoked a statute that allows the Department to ignore any law (especially environmental protection laws) that would delay the construction of the border fence (for analysis, see SCOTUSblog).

D.C. Circuit Affirms Match-E-Be-Nash-She-Wish (Gun Lake) Band’s Trust Land Decision
The D.C. Circuit Court of Appeals held the Department of the Interior’s decision to place land into trust for the benefit of the Match-E-Be-Nash-She-Wish Band of Pottawatomi Indians near Bradley, Michigan did not violate the National Environmental Protection Act nor did Section 5 of the Indian Reorganization Act constitute an unconstitutional delegation of legislative authority.

Mother Earth Water Walk
Two Anishinawbe Grandmothers, and a group of Anishinawbe Women and Men have taken action regarding the water issue by walking the perimeter of the Great Lakes.
Along with a group of Anishinabe-que and supports, they walked around Lake Superior in Spring 2003, around Lake Michigan in 2004, Lake Huron in 2005, Lake Ontario in 2006 and Lake Erie in 2007.
This year they are walking around Lake Michigan again, with the send off on April 26th in Manistee, Michigan. For more information about the walk, click here.
Ninth Circuit Affirms Constitutionality of Bald Eagle Protection Act
In consolidated cases, the Ninth Circuit affirmed the constitutionality of prosecuting American Indians under the Bald and Golden Eagles Protection Act, rejecting a challenge under the Religious Freedom Restoration Act. A similar case is under review by the Tenth Circuit (United States v. Friday).
The Ninth Circuit applied a 2003 precedent, United States v. Antoine, upholding the law under similar facts. Here are the materials.
